List of Palestinian children killed by Israelis in 2004 lists Palestinian infants, children and youth killed by Israeli soldiers and civilians during the al-Aqsa Intifada in the year 2004.

Human rights groups, non-governmental organizations, international governments and various international bodies have raised concerns that the children's deaths are unnecessary and a violation of Israel's international obligations to protect citizens and non-citizens under occupation. In a report released on November 20, 2004, Amnesty International stated that "Palestinian children have been killed or injured by the Israeli army as a result of deliberate as well as reckless shooting by soldiers; shelling and bombardments of densely populated residential areas including refugee camps in the occupied West Bank and Gaza Strip; the use of excessive and disproportionate force during demonstrations; and the launching of missiles into busy streets to assassinate Palestinian militants." [1] Human Rights Watch [2], Defence for Children International [3] and others have released similar statements.

On October 3, 2004, UN Secretary General Kofi Annan called on Israel "to halt its military incursions into the Gaza Strip, which have led to the deaths of scores of Palestinians, among them many civilians, including children" [4]. The European Union has also issued similar releases and reports, in one case specifically stating that Israel "should respect the Palestinians' right to life", and that it should work "to avoid the deaths of unarmed protesters and especially of children." [5] [6]

In the United Nations Security Council's 4204th meeting, shortly after the start of the Al-Aqsa intifada, a representative for France argued that a "disproportionate [Israeli] response to protests would cause more violence and raise the death toll." Ukrainian representative Volodymyr Yel'chenko said that his country was "shocked by the disproportionate use of force by the Israeli Defence Forces and police against Palestinian civilians", many of whom were children at the time of his statement. Similarly, the United Kingdom has repeatedly expressed horror at "the deaths of innocent children", both Palestinian and Israeli.

The Israeli government and Israel Defense Force (IDF) have claimed that the reason for the high death toll of civilian children is that Palestinian militants "intentionally position themselves in the middle of the Palestinian population, thus using the civilians as a 'human shield.'" [7] They have called on Palestinian groups to respect United Nations Security Council Resolution 1261, which prohibits the use of children in armed conflict, calling it as a "violation of international law." Israel, however, has been accused by Palestinian and international groups of breaching the rights of children. [8] [9] [10] [11] [12] [13] Human Rights Watch has also pointed out that Israel has signed but not ratified the Optional Protocol to the Convention on the Rights of the Child , and defines Palestinians under the age of 16 as minors while Israeli children in the same territories are considered minors until they reach the age of 18. [14]

The Jerusalem Center for Public Affairs has claimed widespread use of Palestinian children as militants and suicide bombers — one commentator describes these children as "Martyrs for the Media" — and to the alleged mobilization by the Palestinian Authority of children to "man the front line in its struggle against Israel, frequently using them as shields to protect Palestinian gunmen." [15]. In November 2004, Human Rights Watch stated that "Palestinian armed groups should immediately end all use of children in military attacks", noting that though the groups have "publicly disavowed the use of children in military operations ... those stated policies have not always been implemented." [16]

However, in its November 2004 Global Report on the Use of Child Soldiers, the Coalition to Stop the Use of Child Soldiers reported that "there was no evidence of systematic recruitment of children by Palestinian armed groups." [17] Human Rights Watch, in its report entitled "Child Soldier Use", also reported that "there was no evidence that the Palestinian Authority (PA) recruited or used child soldiers." [18]

This brother and sister were shot dead within minutes of each other by a single bullet to the head each while they were on the roof-terrace of their home in the southern Gaza Strip town of Rafah. According to Amnesty International, the bullets that killed the children were fired from the top floor of a nearby house, the highest building in the area, which had been taken over by Israeli soldiers shortly before the two children where shot. Journalists found an empty Israeli army ammunition box, spent bullet casings and debris from Israel Defense Force food rations next to holes which Israeli soldiers had pierced in the walls of the house to use as sniper positions. From the Israeli sniper nest, there was a clear view of the al-Mughayrs' roof-terrace, where the two children were killed. According to the family, Ahmad ran downstairs to call for help when his sister was shot in the head. He was then shot in the head as he re-emerged from the staircase onto the roof-terrace.
