Mandatory detention
Mandatory detention is the practise of detaining all unauthorised arrivals, asylum seekers, or illegal immigrants while their claim is processed, or with the intention of deporting them.
Mandatory detention is practised in various forms in different countries. The specifics of the implementation differ from country to country.
Mandatory detention in Australia
Mandatory detention laws were introduced in Australia with bi-partisan support in 1992. This legislation was progressively strengthened throughout the 1990’s reaching a pinnacle in 2001 during the Tampa affair.
